Underpinning the system of regulatory laws, then, is the same kind of thinking that leads to the problems that give rise to the need for regulation in the first place. To be specific, it assumes that it is acceptable for capitalists and their corporations to do some injury, to do some harm, to others and their life-enhancing environments. As a leading pro–free market, pro-capitalist legal academic, and now highly regarded judge, Richard Posner, observed:

Only the fanatic refuses to trade off lives for property, although the difficulty of valuing lives is a legitimate reason for weighing them heavily in the balance when only property values are in the other pan.91
